These Terms of Service ("Terms") are a binding agreement between you ("you," "your," or "Client") and Ever Rose Cleaning Company LLC ("Ever Rose Cleaning," "we," "us," or "our"), a Utah limited liability company located at 1737 W 360 N #632, St. George, UT 84770.

By booking a service, using our website, signing a service agreement, or accepting a cleaning appointment, you agree to these Terms. If you do not agree, please do not use our website or book our services.

1. Services

Ever Rose Cleaning provides residential and commercial cleaning services in and around St. George, Utah, and surrounding Washington County communities. Services may include recurring house cleaning, deep cleaning, move-in/move-out cleaning, post-construction cleanup, and commercial janitorial work, as described in your quote or service agreement.

Service scope. The specific tasks included in your cleaning are defined by the quote, checklist, or service agreement provided to you. Anything not listed is not included. If you want additional work performed, please request it in advance so we can adjust the time and price.

Service area. We serve a defined geographic area. Appointments outside that area may be declined or subject to a travel surcharge, which we will disclose before booking.

Right to refuse or discontinue service. We may decline, reschedule, or discontinue service at any time, including if a property is unsafe, unsanitary beyond the scope quoted, inaccessible, or if a client or occupant behaves abusively toward our staff.

2. Quotes, Pricing, and Estimates

  • Quotes are estimates based on the information you provide about your home or facility (square footage, number of rooms and bathrooms, condition, pets, frequency).
  • If conditions at the property differ materially from what was described, we will contact you before proceeding to discuss a revised price or a reduced scope of work.
  • Prices may change with at least fourteen (14) days' notice for recurring clients.
  • Quoted prices do not include gratuity. Tips are appreciated but never expected or required.

3. Scheduling, Access, and Your Responsibilities

3.1 Access to the Property

You are responsible for providing safe, lawful access to the property at the scheduled time. You may provide access by being present, by providing a key or lockbox code, or by providing a garage or smart-lock code.

If we cannot access the property at the scheduled time and cannot reach you within thirty (30) minutes, the appointment is treated as a same-day cancellation and the lockout fee in Section 4 applies.

3.2 Keys, Codes, and Alarms

If you entrust us with a key, access code, or alarm code, we will store it securely and use it only to perform your scheduled service. Please notify us of any change to codes or alarm settings before your appointment. We are not responsible for false alarm charges caused by outdated codes or instructions you provided.

3.3 Preparing the Space

To let us do our best work, please:

  • Pick up clothing, toys, papers, and clutter from surfaces and floors before we arrive. We are a cleaning service, not an organizing service, unless organizing was expressly quoted.
  • Secure cash, jewelry, firearms, prescription medication, collectibles, and other valuables.
  • Let us know about any fragile, antique, or specialty surfaces requiring special care or products.
  • Ensure running water, electricity, and adequate lighting are available.

3.4 Pets

We are happy to work in homes with pets. Please secure any animal that may be anxious, aggressive, or prone to escaping. We are not responsible for pets that leave the property through a door or gate opened in the ordinary course of service. If our staff cannot work safely due to an unsecured animal, the appointment may be canceled and the same-day cancellation fee applied.

3.5 Children and Other Occupants

For everyone's safety, please keep children and other occupants clear of areas being actively cleaned, particularly wet floors and areas where cleaning products are in use.

4. Cancellations, Rescheduling, and Lockouts

We reserve a dedicated block of time and staff for every appointment. Accordingly:

We will always try to work with you on genuine emergencies, illness, and family situations. These fees exist to protect our team's income, not to penalize you for a hard week — just call or text us as early as you can.

Our cancellations. If we must cancel due to illness, staffing, severe weather, or unsafe road conditions, we will notify you as soon as possible and reschedule at the earliest mutually convenient time at no penalty to you.

5. Payment Terms

  • Payment is due at the time of service unless a written agreement provides otherwise. Commercial accounts may be invoiced on Net 15 or Net 30 terms as specified in their agreement.
  • We accept the payment methods listed at the time of booking. Payments are processed by third-party payment processors; we do not store full card numbers.
  • Recurring service authorization. If you enroll in recurring service and provide a payment method on file, you authorize us to charge that method for each completed service and for any applicable cancellation, lockout, or add-on fees, until you cancel recurring service in writing.
  • Late payments. Invoices unpaid after fifteen (15) days past their due date may accrue a late fee of the lesser of 1.5% per month or the maximum rate permitted by Utah law. We may suspend service on past-due accounts.
  • Returned payments. Returned checks or failed charges may incur a $30 fee.
  • Collections. You are responsible for reasonable costs of collection, including attorney's fees, on amounts properly owed and unpaid.

6. Satisfaction Guarantee

We stand behind our work. If you are not satisfied with any area we cleaned:

  1. Notify us within twenty-four (24) hours of the completed service.
  2. Identify the specific areas of concern.
  3. Give us reasonable access to return.

We will re-clean those areas at no additional charge. A re-clean is our sole obligation and your sole remedy for a service quality concern. We do not issue refunds in lieu of re-cleaning unless we are unable to schedule a return visit within a reasonable time.

7. Limits on What We Clean

For the safety of our staff and your property, we do not:

  • Climb ladders higher than a two-step stool, or work outside second-story windows;
  • Move furniture or objects heavier than 25 pounds (we clean around and under where reachable);
  • Clean or handle biohazards, including blood, bodily fluids, human or animal waste, vomit, used needles, or drug paraphernalia;
  • Remediate mold, asbestos, lead paint, hoarding conditions, insect or rodent infestations, or fire and flood damage;
  • Handle, clean, or dispose of firearms, ammunition, illegal substances, or hazardous chemicals;
  • Clean litter boxes beyond routine surrounding-area cleaning, unless expressly agreed in advance;
  • Perform exterior work, pressure washing, carpet shampooing, or window washing unless separately quoted;
  • Provide childcare, pet care, or laundry services unless expressly quoted.

If we arrive and encounter any of the above, we may adjust the scope, reschedule, or decline the appointment, and Section 4 cancellation terms may apply.

8. Damage, Breakage, and Claims

We treat your home with care, and our team is trained accordingly. Even so, accidents occasionally happen.

  • Report any damage or breakage within twenty-four (24) hours of the service so we can investigate while the facts are fresh. Claims made after that window may be denied.
  • We will repair or replace the item, or credit your account for its fair market value, at our reasonable discretion.
  • We are not responsible for: pre-existing damage or wear; items that were already broken, unstable, loose, or improperly mounted; deterioration of surfaces caused by age, prior damage, or previously applied products; damage to items you did not disclose as fragile, antique, or requiring special care; or normal wear from routine cleaning.
  • Please secure irreplaceable and sentimental items. We will not clean or handle them if you ask us not to.
  • Insurance. Ever Rose Cleaning maintains general liability insurance. Proof of coverage is available on request.

9. Non-Solicitation of Staff

Our employees and contractors are trained at significant expense. For the term of your service with us and for twelve (12) months afterward, you agree not to directly or indirectly hire, engage, or solicit for private cleaning work any Ever Rose Cleaning employee or contractor who performed services at your property, other than through Ever Rose Cleaning.

If you do, you agree to pay a placement fee of $2,500, which reflects a reasonable estimate of our recruiting and training costs and is not a penalty.

10. Text Messaging (SMS) Terms

By providing your mobile number and opting in, you consent to receive text messages from Ever Rose Cleaning at that number, including appointment confirmations, reminders, schedule changes, arrival notifications, invoices and payment reminders, and — where you have separately opted in — promotional offers.

  • Messages may be sent using an automatic telephone dialing system. Consent to marketing texts is not a condition of purchasing any service.
  • Message frequency varies. Message and data rates may apply.
  • Reply STOP to any message to opt out. Reply HELP for help, or contact us at (435) 429-5761 or [email protected].
  • Carriers are not liable for delayed or undelivered messages.
  • We will not sell, rent, or share your mobile number or SMS consent with third parties or affiliates for their own marketing or promotional purposes. See our Privacy Policy for details.

11. Photographs and Marketing

With your permission, we may photograph completed work for training, quality control, and marketing. We will not publish images that identify you, your address, or personally identifiable belongings without your express written consent. You may withdraw consent at any time by contacting us, and we will stop using the images going forward.

12. Website Use

Our website is provided for informational purposes and to let you request quotes and schedule service. You agree not to use the site to transmit unlawful, harassing, or fraudulent content; to attempt to gain unauthorized access to our systems; or to scrape, copy, or reproduce our content for commercial purposes without permission.

All content on our website — text, logos, photographs, and the Ever Rose Cleaning name and marks — is owned by or licensed to us and may not be used without our written permission.

13. Disclaimer of Warranties

Except for the satisfaction guarantee in Section 6 and any warranty expressly stated in a written agreement signed by us, our services and website are provided "as is" and "as available." To the fullest extent permitted by Utah law, we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that cleaning will remove every stain, odor, or mark, particularly those that have set, penetrated a surface, or resulted from prior damage.

14. Limitation of Liability

To the fullest extent permitted by Utah law:

  • Our total liability to you for any claim arising out of or relating to our services or these Terms will not exceed the greater of (a) the amount you paid us for the specific service giving rise to the claim, or (b) $1,000 — except for claims covered by our general liability insurance, which are limited to the applicable policy limits.
  • We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost business, or loss of data, even if we were advised of the possibility.
  • Nothing in these Terms limits liability that cannot lawfully be limited, including liability for gross negligence, willful misconduct, fraud, or personal injury or death caused by our negligence.

15. Indemnification

You agree to indemnify and hold harmless Ever Rose Cleaning Company LLC, its owners, employees, and contractors from claims, damages, and reasonable expenses arising out of: your breach of these Terms; your failure to disclose a known hazardous condition at the property; injury caused by an unsecured animal; or your instruction to use a specific product or method that causes damage.

16. Independent Contractor Relationship

Ever Rose Cleaning is an independent business. Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between you and Ever Rose Cleaning or its personnel.

17. Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including severe weather, wildfire or smoke conditions, flooding, road closures, utility failures, epidemics, government orders, or labor disruptions. We will reschedule affected appointments at no penalty to you.

18. Dispute Resolution

Informal resolution first. If a dispute arises, please contact us at [email protected] or (435) 429-5761. Most issues are resolved with a phone call. We ask that you give us thirty (30) days to work it out before starting formal proceedings, and we commit to the same.

Governing law. These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules.

Venue. Any action not resolved informally will be brought exclusively in the state or federal courts located in Washington County, Utah, and both parties consent to personal jurisdiction there.

Small claims. Either party may bring a qualifying claim in Utah small claims court.

19. General Provisions

  • Entire agreement. These Terms, together with your quote or signed service agreement, are the entire agreement between us on this subject. If a signed service agreement conflicts with these Terms, the signed agreement controls.
  • Changes. We may update these Terms. The updated version takes effect when posted, with a revised "Last Updated" date. For material changes affecting recurring clients, we will provide notice by email or text. Continuing to use our services after an update means you accept the updated Terms.
  • Severability. If any provision is found unenforceable, the rest remains in effect.
  • No waiver. Our failure to enforce a provision is not a waiver of it.
  • Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a sale or reorganization of the business.
